Wrongful death suit filed against nursing home | Whitlock Law, LLC

When you have a loved one in a Maryland nursing home, you expect them to be safe. Sadly, that isn’t always the case. A family recently filed a wrongful death lawsuit against a facility in another state.

WHAT HAPPENED THAT LED TO THE LAWSUIT?

An 80-year-old woman was raped and murdered in a nursing home that was said to have poor conditions. A wrongful death lawsuit was filed with the Superior Court after the grandmother was discovered smothered to death in February 2022. Another nursing home resident was charged with the woman’s rape and murder.

Nursing home residents are among the most vulnerable. When family members leave a loved one in a facility, they expect them to be well cared for and safe. While some situations can occur that result in personal injury, no one should ever be assaulted and killed.

POOR HISTORY FOR THE NURSING HOME

The wrongful death lawsuit was filed by the woman’s husband and daughter. Police investigated the murder and discovered that the staff at the nursing home were rated very poorly and that the nursing home itself had a bad history compared with other facilities.

Police made trips to the nursing home throughout 2021 for a variety of issues. Most of those crimes involved drugs, assaults and thefts. Some residents were administered illegal narcotics and there was an issue with overdoses.

The facility had many health inspection violations as well. One resident died of nursing home neglect after having the same IV in their arm for over a week.

A former employee of the nursing home stated that they weren’t surprised to hear that a resident had been raped and murdered. They pointed out that the facility was out of control and that it was inevitable for such a tragedy to happen.
