What Is Expungement?

Expungement is the legal process of sealing certain criminal records, making them inaccessible to the public, although they may still be accessed by law enforcement or court officials. Once a record is expunged, most employers, landlords, and other members of the public cannot access the information. This can provide a fresh start for people who have been involved in criminal cases in the past. In Virginia, expungement is typically available in cases that did not result in a conviction, such as when a person was acquitted or when charges were dismissed. Expungements will also be available if a person receives an absolute pardon from the governor.

Virginia's New Expungement Law Effective July 1, 2025

A groundbreaking change to Virginia’s expungement laws will take effect on July 1, 2025, expanding the eligibility for sealing criminal records. Under this law, certain misdemeanor convictions will become eligible for expungement. These include:

Minor theft or larceny charges
Simple possession of marijuana
Disorderly conduct or trespassing
Possession of alcohol by minors

For some low-level offenses, the law provides for automatic expungements after a specific period. However, a person may also apply for expungement of most misdemeanor convictions except for DUI or domestic assault, as well as certain Class 5 and Class 6 felonies. When applying for expungement in Virginia, certain restrictions may apply. These include:

Felony Convictions: Any Class 1 or 2 felony convictions will make a person ineligible for expungement. A Class 3 or 4 felony conviction within the last 20 or any other felony conviction within the last 10 years will also prevent a person from receiving an expungement.
Waiting Period: A person cannot receive an expungement for a misdemeanor conviction until seven years after the date they were originally convicted. A 10-year waiting period is required for expungements of felony convictions.
Additional Convictions: Any subsequent criminal convictions (other than traffic violations) within the waiting period after the date of the original conviction will make a person ineligible for expungement.
Alcohol or Drug Dependency: If the original offense involved the use of drugs or alcohol, or if court records show that the person struggles with substance abuse, they will be required to demonstrate that they have received treatment or engaged in rehabilitation before an expungement will be granted.
Lifetime Limits: During a person's lifetime, they can only receive expungements from two sentencing events. If a person is convicted of multiple charges at the same time, that is considered one sentencing event. This lifetime limit only applies to criminal convictions, and there is no limit on expungements of records related to cases that resulted in acquittals or dismissals.
